Terms and Conditions of Use for Membership Program

  1. Application of These Terms and Conditions
    1.1 These terms and conditions constitute the contract between you (our member) and us (EMCL Ltd, the operator of the “Membership Program” or “the Program”). Other merchants (“Participating Merchants”) may join this Program to provide you with more rewards and offers.
    1.2 In these terms and conditions, the following terms are defined as:
    a. "Member" – a person who has successfully applied for this Program
    b. "Points Membership" – the points membership issued to you under this Program, entitling you to rewards and privileges
    c. "Stores" – includes Private Structure, MAD and MAD Lifestyle physical shops and online stores in Hong Kong and Macau (excluding all department store counters, consignment points and outlet stores)
    d. "Point(s)" – the basic unit for calculating offers entitled to you when shopping, under this Program at our physical or online stores

  2. Application for Membership
    2.1 By applying to become a member, you declare (and we are entitled to rely on such declaration) that you are aged 18 or above and have the capacity to enter into a legally binding contract.
    2.2 Eligibility for membership is subject to specific terms and details as displayed at stores or on the online shop, and may be changed by us at any time without prior or separate notice.
    2.3 To become a member, you must fill in a membership application form and provide specific personal data.
    2.4 You may only apply for one membership. After verification, all duplicate applications and the points earned therein will be cancelled.
    2.5 All information on the application form must be true, accurate, and complete, without any dishonest or illegal elements. Otherwise, we reserve the right to reject your application.
    2.6 If your application form is unclear or incomplete, we will contact you by phone/email and require you to provide the missing information. If you cannot provide the information required, we reserve the right to invalidate your application.
    2.7 We may, at our absolute discretion, decline your application.

  3. Membership Validity
    3.1 If you have not shopped at any of our physical or online stores for 3 consecutive years, your membership and any points and offers accumulated will be cancelled. You must reapply for membership.
    3.2 Re-application will be subject to the prevailing terms and subject to approval.

  4. Offers and Rewards
    4.1 Discount Offers
    4.1.1 Members can enjoy up to 10% discount when purchasing designated regular-priced items at any Private Structure, MAD or MAD Lifestyle store/online shop in Hong Kong/Macau, and an extra 5% off on designated sale items. (subject to the instructions in-store or on the online shop)
    4.1.2 Discount offers do not apply to selected special items, consignment items or cash vouchers.
    4.1.3 Discount offers do not apply to all outlets and clearance sales.
    4.1.4 Discount offers cannot be used in conjunction with other coupons.

4.2 Points Rewards
4.2.1 Upgraded points members can earn 1 point for every $1 spent at our stores or online shop.
4.2.2 Points are calculated based on the net price after deducting any in-store/online cash coupons, other vouchers or discounts. Fractional cents will not be counted. For example, if your net price is HK$188.9, the system will take it as HK$189 for calculating points.
4.2.3 Points are cleared twice each year, at mid-year and year-end. Points are valid for 365 days from the month they were earned, and all valid unused points may be accumulated. For example, all unused but valid points are allowed for continual accumulation.
4.2.4 During promotional periods, you may enjoy bonus points for purchasing certain goods. Such bonus points may not be shown on your receipt. Details and terms will be published by the relevant store or on the online shop.
4.2.5 Discount and points rewards will not be given for selected item purchases or under other promotions/plans, and also not for cash voucher purchases. Such restriction notices will be published at the stores or online shop.
4.2.6 Points earned in-store will be credited to your points membership account within 3 working days, and only be usable after the update. For online purchases, points will be credited within 15 days after receipt of goods.
4.2.7 All points are personal and non-transferable.
4.2.8 In case of any disputes regarding the points rewards, we reserve the final decision.

4.3 Birthday Month Offers
4.3.1 During your birthday month, you will receive double points for in-store or online shopping.
4.3.2 Birthday month offers will only apply after your membership application is successful.

4.4 Other Points Rewards and Offers
Occasionally, we will run one-off promotional activities at selected stores/online shops, where extra offers or points may be granted. Details and terms will be announced at the relevant stores or online shop.

4.5 Points Redemption
4.5.1 You may redeem different gifts or cash coupons with points during specified periods, subject to the terms and conditions published at the relevant stores or online shop.
4.5.2 We may offer occasional one-off promotions at certain stores or online shops, where selected goods or gifts can be redeemed or purchased using points, subject to the terms and conditions published at the relevant stores or online shop.
4.5.3 Each month you may redeem shopping vouchers or goods up to a maximum of 10,000 points.
4.5.4 Redeemable points are shown in your online account.
4.5.5 All redeemed coupons cannot be refunded or exchanged for cash, or for cash change. Please check your redeemed gifts upon collection as we will not replace gifts or points afterwards. We also do not guarantee the quality, services or outcomes of products supplied by third-party vendors, nor bear any liability arising therefrom.

4.6 Use of Points Membership Benefits
4.6.1 Your membership points and benefits are non-transferable, non-saleable, non-purchasable, non-tradable and/or non-reproducible in any form, for use exclusively by the registered member. You are also responsible for safeguarding all security credentials of your account. We will not compensate for any loss arising from mishandling such information, including lost points or benefits.
4.6.2 You must use your registered email or phone number to log in. When your account is shown as “Basic” or “VIP” member, you are eligible for membership benefits and can earn points.
4.6.3 When redeeming gifts or vouchers, you must log in to the Marathon mobile app / online shop using your registered email or phone number. If you are unable to provide sufficient information, we reserve the right to refuse the redemption.
4.6.4 Occasionally, some promotions may not be used together with membership offers. Details are available in the relevant shops and/or website and/or promotional materials.

  1. Exchange/Refund
    5.1 If you are granted an exchange or refund for an in-store/online shop transaction in reasonable circumstances, any (i) points earned and/or (ii) gifts or vouchers redeemed as a result of that transaction will be deducted/adjusted accordingly. Depending on the circumstances, your membership may also be cancelled.
    5.2 All items redeemed or purchased using points cannot be exchanged or refunded for cash.

  2. Membership Cancellation
    You may cancel your membership at any time by submitting and signing an "Enquiry Form" at any store, by emailing cs(2)emcl.com.hk or sending a WhatsApp to (852) 5523 9610. Upon cancellation, you will forfeit all remaining points and membership offers. For verification, you must provide valid identification.

  3. Others
    7.1 As this program relies on communication and power networks which are beyond our control, we cannot guarantee uninterrupted service but will endeavour to support system operation.
    7.2 We reserve the right to update any content, offers, or promotions in the Membership Program, all of which shall be governed by these and other applicable terms and conditions. Members should be aware of any changes, and by enjoying members’ rights, agree to all the related terms and conditions. We are not responsible for any loss due to changes or updates.
    7.3 If we terminate this Program, we will announce notice three months in advance on the Private Structure, MAD and MAD Lifestyle websites.
    7.4 We may, at our discretion, refuse, withdraw, cancel, or terminate membership and/or member privileges and withhold any compensation if we reasonably believe that:
    a. anyone has breached or attempted to breach these terms and conditions;
    b. anyone has abused or attempted to abuse the Program;
    c. a member or third party on behalf of a member has gained member privileges by fraud;
    d. any theft, improper, abusive, objectionable conduct or provision of false or misleading information in connection with the Program;
    We also reserve the right to claim compensation for any loss or reasonable expenses incurred due to such violations.

7.5 We may amend these terms and conditions at any time without prior notice. Continued membership will be deemed as acceptance of the updated terms, and previous versions will be superseded.
7.6 Images of electronic vouchers and cash coupons are for reference only. Actual items shall prevail.
7.7 We shall not be responsible for any failure or delay to perform obligations under these terms and conditions due to circumstances beyond our control (“Force Majeure Event”). Our performance will be suspended during the force majeure event, and the period for fulfilling obligations will be extended accordingly.
7.8 EMCL Ltd employees are not eligible for membership.
7.9 These terms and conditions are governed by the laws of Hong Kong. Both we and members submit to the non-exclusive jurisdiction of Hong Kong courts.
7.10 In case of inconsistencies between the Chinese and English versions of these terms and conditions, the Chinese version shall prevail.
7.11 EMCL Ltd reserves the final decision regarding these terms and conditions.
